8 teacher, looks it is very worried, the problem is that I don't know when perm will be approved or denied. If it is approved before 11/15/2011, once I submit I-140 before 11/15/11, will my status be kept? am I right?
if my perm is still pending on 11/15, that means I have to leave US in 10 days? right?
-Your PERM or I-140 filing has nothing to do with your status. Your status or legal stay depends on your I-94. If your I-94 expires, you are illegally present. If you have an approved I-140 before your H1 reaches the 6 year limit, you can file your H1 extension for another 3 years beyond the 6 year limit. You can legally stay during your H1 extension pending even if your I-94 expires.
