Filing I-129B MTR for a denial I-485 is very common and it is the only way by this time. The reason your lawyer used to the local office sounds reasonable. But it did not work in the local office because the local IO had returned the case to the USCIS Service Center and thus, the local IO can not do anything about it (it iwas too late and the IO had no right to deal with it). But it does not mean it will not work in the MTR. So, just talk to your lawyer and ask him/her to prepare the MTR filing and I believe you have a good chance.
