The letter from USCIS doesn't mention the depart time, such as 10 or 30 days. Just say that from now on the stay is illegal. I checked the related email in this site. Anyone has clearer answer for my questions:

1)the illegal stay should be counted from the date of denial or the date receive the letter.If they leave right now, is there any effect for their future visa application and green card application in China?

非法滯留期從拒絕之日起算。沒有影響,因為你的非法滯留期隻有不長的若幹天而已,隻有長達至180天以上才會有重大的影響。


2)Our valid I-94 issued to Oct2007, since there is no valid I-94 after that, is the stay in between these dates legal?

不太明白你的問題。你是說你父母的前次的I-94有效期到10月麽?那麽你這次為他們申請延期太早了!這很可能就是被拒絕的原因。Anyway,他們可以合法居留到I-94到期日為止。


3)If we apply for Green card for them in US, just pay penalty ($1000) or so, the over stay has no effect for them to get green card?

對,沒有影響。隻要是合法入境即可,隨後出現的非法居留隻要交罰款即可。
