I don't think dependant applicant will get any special treatment (can be out of status for more than 180 days). INA has 245(k) for EB-1, 2, 3, and some EB-4 applicants, and dependant will be treated the same.
I pointed out she could use 245(K), but I'm not so sure after I saw she did I-20 reinstatement before, reomstatement means she had been out of status. The question now is for how long?
