Happy New Year! Please help with my case!

Hi, Xiaobiatu, Pjiang and other experts, Happy Chinese New Year!

Could you please help look at some more of my questions? Thanks!

1. My EB3 140 was approved and I filed 485 last July based on EB3 (PD 2005). At that time my EB2 Perm was also approved and I later field EB2 140, which is still pending. I asked my lawyer if I need to refile 485 based on this new EB2 140 or to relink 485 to EB2 140 once it's approved. His answer, I don't need to do anything. According to him, my EB3 based 485 might be approved even though my PD (2005) is not current.

I read many of your posts here and it seems very clear that 485 won't be approved if PD is not current. So why my lawyer insisted I don't need to do anything? Is he wrong? Anybody could help me with this?

If he is wrong, what should I do? Relink 485 to EB2 140 once it's approved? If I relink by myself, then does it mean my lawyer will stop representing me and USCIS will contact me directly in the future?

2. My H1 expired and I decide to use EAD. Do I need to inform my employer or USCIS?
