關於黨員：如果嚴格依法辦事

關於黨員，即I-485中問題：Have you ever been a member of, or in any way affiliated with, the Communist Party or any other totalitarian party? 回答“YES” 或“NO” 。

這裏問的是：你是否曾經是，或現在仍然是共產黨或任何其他極權主義政黨，或其任何附屬組織的成員？

如果嚴格依法辦事：

1、怎樣才是如實回答。對於從中國大陸來的人來說，如果你參加過共產黨、共青團、少先隊中任何一個組織，應該填“YES” ，否則就是不誠實。XBT說移民官不會因為填了交通事故而不批I-485，所以共青團、少先隊不用填。這是偷換概念。因為批不批I-485是移民官的事，填不填是你是否誠實的事。

2、移民官的處理。填“NO” 。你的其他條件符合，立即批準I-485，把綠卡寄給你。填“YES” 。不能立即批準I-485。你的CASE將由地區移民局安排麵試，可能由移民法官決定。

3、即使出國5年，你現在仍是黨員，而非“前黨員” 。你出國後，不論多長時間，你的黨籍仍然保留。你回國時，隻需要恢複組織生活和交納黨費，無需重新入黨。隻有兩種文件可證明你與黨斷絕關係：(1) 被 開除黨籍的證明；(2) 自動退黨被黨組織接受的證明。其他的所謂公證是無效的。

4、你填“YES” ，而且你的確入過黨，那你就是現黨 員， 無移民資格。如你是美國公民或永久居民的直係親屬可申請豁免。理由例如，如果你不能在美國居住，將給美國公民帶來極大困難。

你如果填了“YES” ，當然證明了你的“誠實” 。但是，你又要去找其他變通的方法，不是很奇怪嗎？
