I am not eligible for 245i, but my h1 gap and work without permit are less than 180days. If my I485 denied, can I go to china to do consular processing? Last time your reply to other post, you mentioned the I140 is still valid, is that true for my case?
However, practically, for my case, what is the chance to get I485 approved do you think?
