In September, after we knew the retrogression, we asked our lawyer to query our LC petition status. The email reply from BPC was that our case was still being processed (some bastard in BPC did not really check our case status before replying the email...) But yesterday we found out that our LC was actually approved 3 months ago in July this year. So we unfortunately missed filing I-140/I-485 before 10/01. The reason why we did not get the approval notice was the approval letter with ETA750 forms was probably unfortunately lost during delivery process since our lawyer changed her office address. We did not find it out until yesterday. Now we could only get a copy of the certification letter for BPC, but they refused to send the certified ETA750 by saying that they could not recertify a case. My questions are:
1) Can we submit I-140 with this copy of certification letter without the original ETA750 forms (using a copy of the originally submitted forms)?
2) Is there any requirement about filing I-140 within certain window after LC was approved? (I heard of this, but could not find official information from BCIS)
Did anybody have similar experience before? How did you guys handle this situation? Thanks for suggestions. Really appreciate it.
