Green Card Fraud

One of employees in my company quit his job in order to work for another company outside the U.S.A. His

Labor Certificate is still pending. He made some kind of deal with his boss, so that his boss will continue sponsor his green card.

Apparently, we all believe he will never return back to this company again. So, does this constitute a fraudulent immigration case? Is there any law against this kind of fraud?
