I suggest you leave those birds alone.

You never know who can sue you for what reason. In Taxes a dog almost got put down because she killed a duck, and it took more than 500k signatures from a internet campaign and half a year to save it.

Get chicken wire or something similar to cover your plants, which works well against deers too.
