問一個indiana eviction的問題

需要evict 一個印第安納波利斯的tenant, 一年的lease已經到期，現在是month by month, 已經欠了幾個月的租金了，現在下了決心要驅除， 找了律師，律師說要先發30天搬家的notice, 因為lease上有寫要terminate lease的話要給30天notice.  我的理解是我是要evict for nonpayment of rent, 為什麽要先發notice to move, 直接發10 天notice不行嗎？  是律師的做法對還是我的理解對？
