at least talk with a lawyer and see how it will go. My 2 cents regarding when one is right, but "not using it on time" here in the US. Gradually you will find that you become the one to be blamed. Nobody will appreicate your "nice" action. You will just need to figure out what is the best for you. If sueing is best for you, do it. Again, if you do not go ahead, do not expect others will appreciate you.
