人生完整了，車禍求助

星期三上班途中，開俺的Ford focus在35邁限速在雙向5車道以35左右的速度正常行駛
，突然一輛
pick-up從右側飯店的parking lot竄出來，躲閃不及，結結實實的撞上了。如圖. 俺的
車基本
total了。人還好，隻是胸口火辣辣的疼，直接被救護車送到醫院。人還好，隻是胸骨
受點輕傷。星
期四拿到警察報告，應該是對付完全責任。 今天收到對方保險公司email， 徹底崩潰：

insured is the approximate cause but not at a 100%...Our insured was 
exiting the parking lot he had already crossed the right lane and was 
crossing over the left lane that you were in and you told me that you 
never saw him.  Our insured was driving a dodge ram truck f1500.  There 
was no obstruction to your view,  clear intersection, you should have 
seen him. Because of lack of observation on your part, Allstate is 
willing to pay 70% of your damages. Thank you.

當時完全懵了，沒有找證人，警察報告上倒是有證人電話。 如何和對方保險公司argue
？ 如果找律
師， 官司我贏了誰出律師費？謝謝
