5 車連環撞, 兩車在我之前, 兩車在我之後.險 我刹車並fully stopped, 當看到前車突然刹車. 然後被後麵track衝撞, rear-ended to 前車. 警察報告認為最後driver引起這連環車禍. 兩個半月調查後, 他的保險公司說雖然我的前車說隻感到一次impact, 但我後麵track司機說看到我先撞到前車, 這司機刹住了車, 然後被最後車相撞才撞向我. 所以保險公司不肯全賠我的damage. 感覺track司機從他的角度看誤以為我已撞上, 保險公司卻抓住這不肯放. 我認為如 果我rear-end前車在先, 然後再被track撞, 我的前車將會感到第二次impact. 那adjustor 很難溝通. 我的車已不能起動, 前後都有damage. primary estimation is about $6500. 我們今年剛剛撤掉collison coverage. 所以必須deal with it ourself. 有些問題想請教大家, 懇請指教.
- 我包險公司建議escalate to that adjustor's boss to get the decision reviewed/changed. I am not sure if this can work out, 是不是應該直接去small claim court?
- 如果去small claim court, 是不是應該sue最後driver?
- primary estimation is not exactly real cost, should I take it as claim value, or just ask for 'whatever it costs, but no more than 10000"?
- should I be responsible for the other side's expense to attand hearing (such as off work, witness travel cost)?
