地主被狡猾的房客坑了之後續

今天繼續出庭。黑大叔把其他案子嗖嗖地打發了，然後開審。

 

我的律師開問:

-Mr, X, did you have a receipt from Mr. Y for rent paid?
-Yes.
-What's the date on the receipt?
-Feb 10.
-Did you give Mr. Y a bank card to get money?
-Yes. 
-When did he get the money and when did he gave you the receipt?
-He went to get the money and came back to give me the receipt.
-Did he also give you a check date Feb. 13?
-Yes. Because there was $$$ on the card. I owed him $$. I told him to take all the money and give me the rest.
-Why is the date Feb 13?
-That's what he wanted.

這時候黑大叔一皺眉頭:

-Did you said he came to your house to get the card, then went to get the money, then came back to give you the receipt and check? Why didn't you go with him?
-I have something else to do.
-Why did he give you cash instead of a check?
-That's way he wanted.

我的律師繼續問:

-Is the card activated?
-Yes
-Was the card activated between Feb 10 and 12?
-Yes.
-Do you have any record from the bank showing the card was active?
-No.
-Do you have any record from the bank showing transactions?
-No.
-Did you have any text communication with Mr. Y afterwards?
-No, my phone has been cut for weeks.

下麵我的律師開始問我:

-Mr. Y, what happened on Feb. 10?
-I went to collect rent money, Mr. X gave me a card saying there would be money on the 12th. But when I went to the bank it was denied. I have the print out from the ATM and the card here.
-Mr. X, here is the card and the receipt from bank with the last 4 digits agreeing. (passing to judge).
-I found there was no money so I cancelled the check.
-Your Honor, I have a text transcript from my client's phone dated Feb. 15 here...It said:" This is X, I want to come to pay, but I need the card back..." (passing to judge).
-Mr. Y, do you have your phone with you that has the text record?
-Yes. 
-Please show me the text you received.
-.....Here it is.
-Your honor, do you want to check the text on my client's phone?
-Yes( receiving the phone)
-Mr. X, did you send Mr. X a text message on 10:38am Feb. 15 from this number?
-No, this is not my phone. I have this phone. It is off.
-Mr. Y, is this your tenant's phone?
-This was the first time he contacted me from this phone. But he said who he is in the first message, and he said he was coming to court.
-Your Honor, no more questions.

黑大叔一拍驚堂木:

Judgement and warrant granted immediately! Next one! 











-Mr. X, did you texted to Mr Y at 10:38 Feb. 14 saying you want to come and pay?
-No. My phone has been off.
