" asked weather we should take an MRI also given his statement about soft tissue injury but he consider that to be unnecessary." ----- this is THE key because only MRI can make the diagnosis of new/acute fracture, unless you have an X-ray or CT couple of days ago which showed no fracture and the CT scan on the day in ER showed the fracture.
If you can substantiate it, then the ER physician is at fault. This is one of the common "mistakes" ER MDs make -- failure to order adequate test. The radiologist, on the other hand, should be exampted since it is acceptable to say the L2 fracture could be old especially given the "history" of old fracture.
