離婚--求助老貓及懂法的人

因為她的丈夫的暴力傾向，我的一個親戚打算離婚(她挨打過幾次，因考慮到他的前途，未報警)，她現已經回到了國內，不再想回來了。她結婚的時間不長，一年半，沒有孩子。婚後以兩人名義買有一房子，首付20%以及一輛在女方名下的新車。除房子銀行貸款外，現有一些信用卡欠款(主要用於買家具等一些大物件)。丈夫婚前買有一房子在出租。丈夫的收入大約在$10萬/年左右。在這婚後的一年半期間，女方大約有3萬左右的進賬，現無工作。象她這樣的情況，我的親戚能在美國起訴離婚，以拿到他們房子的一半首付，以及她的車和部分的401K(一年半)？是否可以讓別人代找律師？因我的親戚已在中國，她的成功的可能性有多少？
