請懂法律的各位朋友看看這個案子

本人於兩年前通過租房公司租了個房子，合同本來今年５月底結束，因我們沒能提前兩個月告訴他們，他們給自動延長到明年五月份。按合同規定，如果合同沒到期的話，可以提前兩個月告訴他們，他們會罰１０００美元再加兩個月的房租。總共罰款約４０００美元。

我們是月（提前兩個月）告訴他們的我們八月底搬出。我們也付了八月底的房租。但我們是八月１１號搬出的房子。在八月１１號之前樓上的空調不幹活，晚上熱得不行，等了兩個月他們也沒給修空調。現在出租公司，讓我們付到明年五月份，加上各種莫須有的罰款，總共一萬八千多美元。

若住到八月底，他們就不會罰我們到明年五月份。我的問題是我們一定要physically住到八月底他們才按他們會按１０００美元再加兩個月的房租罰嗎？難道physically住到八月十一號，他們就俺罰到明年五月份嗎？可是我們是付到８月底的啊？　難道天下就沒到理可將了嗎？


我的問題是我們一定要physically住到八月底嗎？

我們要告這個出租公司，以什麽名義告他們呢？
