Hi,
I was a former Datek client and when Ameritrade acquired Datek, they must have lost my information. The result is that the SSN they have doesn't match what the IRS has. SO Ameritrade asked me to get a SSA-7028 from the Social Security Adminstraton and send it to them. Now they removed the trading restriction but they still with holding $1,200 from my account. I called Ameritrade but their customer service was very bad. They kept telling me that this money was withholding by IRS and Ameritrade has nothing to do with it.
Now I wonder if I can sue ameritrade to get the money back because:
1). It's Ameritrade's fault that they lost my information, because I don't have any problem with datek.
2). After I sent them the SSA-7028 form as they required, they should not saithhold any money.
I wonder if it is worth suing Ameritrade or accpeting the $1,200 loss. If I can sue them, what kind of lawyer I should hire and what's the fee is, and what reason I should use to sue Ameritrade.
