I am not suggesting that for every accident you have to go to court. Matter of fact if you have been here for long you should know that I am advocating to settle with insurance, not court action because of the lenthy and expensive process, and unpredictable outcome. And, I am not disputing that everybody should get enough coverage on their car insurance. I am discussing the likely outcome of an assume court action. You can not mislead people that they should always go for insurance not a court action. Buying enough insurance is totally irrelecant in this case and the above one since the other driver was at fault and even if you bought enough insurance, you have to rely on the other driver's insurance to cover the loss. What if the other driver, such as the poor illegal immigrant who does not have insurance? Does it matter how much insurance you bought for yourself? You might argue your own insurance would cover but I for one would under no circumstances trigger my own insurance claim because it would increase my premium.

Besides, you completely missed the point that we are discussing another alternative to insurance. Sometimes court action is inevitable.
