Take slip and fall cases for example. Most people would assume that if you fall and get injured in a store you can go there and ask them for compensations. Yes they would compensate you no matter whose fault it was. It is not because they are generous but if they settle they could avoid an expensive lawsuit. They'd rather pay $20k to avoid paying $500k if settled in court. That is why I always said that you have to treat everything just like you would go to court later, even if you settle for insurance money.
I brought an example several weeks ago. Several years ago in New York a violinist coming out of a play of Phantom of the Opera and walked on the street near the theater and tripped by a small piece of stone and fell and twisted her knee, resulting in a knee surgery. You may think this is totally bad luck. Most people would do. Overall, it is just a piece of stone on the street and who would be responsible for that? Well, the plaintiff lawyer actually found evidence that the stone was falling from a building nearby and forced defendant to settle for $400k. I don't care about insurance. Civil lawsuit was the topic here.
