In sept. I had some argument with my hu*****and..We had some push and struggle during the argument. He is stupid enough to call the police. He just wants to scare me and chill me down, not really want me to go to jail. When police came and asked me to stay at friend's house overnight, I refused. and then the police said they saw a redness behind my hu*****and's ear. So they arrested me. Both My hu*****and and I are stunned... I stayed one night in jail and was told I would be in front of judge the next morning. But I was let go next morning without going to court. no charge, no conviction.
I came to U.S on a K-1 visa (American citizen's fiance) and was married on 2003. Now it is time for me to change my status from conditional green card topermanent green card. Both of my hu*****and and I are concerned how this incident will affect me. So yesterday I went to sheriff department and got a police report. I was so upset to see that my hu*****and said so many negative things about me and I now realised why that day it is me instead of him who was put in jail. I was trying to hide when police asked me question that day because I am afraid that they will take away my hu*****and. At the end of police report. it shows prosecutor denied a warrant due to insufficient evidence for me for domestic violence.
That is my situation. I am concerned that I will have trouble in my permanent green card application process because my green card is based on marriage. and the arrest is about domestic violence. What can I do to overcome it. The other thing that is bothering me is "will employer see my arrest record during a background check" even though I am not charged or convicted?
