I don't think it is a big deal. In most states police can make an arrest if he reasonably believes that a felony was committed and you were the person responsible. Or, if it is a misdemeanor in commission, he could also make an arrest. Other than these two situations, he has to have warrant to arrest people. Battery and assault are common law felonies so that the police could make a legal arrest if he suspected that you battered or assaulted your hu*****and. BUT, remember that everybody is presumed innocent until convicted. Unless you were convicted by court, arrest does not mean anything. For example, public drunkness is a misdemeanor in most states and police would take the drunkard into custody until he is sober, yet, most states do not prosecute drunk people.
