In the US you will need to sign some papers before a major surgery; those papers protect doctors from lawsuits. But you can still sue the doctor if you have evidence showing that the doctor intentionally or carelessly made mistakes.

This principle also applies to home inspection. If you have evidence showing he/she intentionally or carelessly made mistakes in home inspection, you can sue him/her.
