In CA, a driver has the responsibility to look out for other vehicles, otherwise, he or she may be sured for negligence.
If the other driver has no fault, why his insurance company is taking responsibility for him?
The witness is not his witness, she just made a statement to the police. Based on her statement,she did not even see the other driver's vehicle.
