Roe v. Wade held...

The Supreme Court held that personhood under 14th Amendment could not be granted to a fetus before “viability”—the point around 24 weeks of pregnancy when a fetus can survive outside the womb. Roe has since been overturned. And the SC refused to hear fetus personhood rights case.
