各位老師好,
我今年想自己房子修建一道fence,給兩側鄰居打了招呼,也從hoa拿了批準。結果遇到了一個特別多市的鄰居,找各種理由不想讓我修建,最後他找到起初修建房子的secondary plat,裏麵有covenant,conditions and restrictions,有一條關於patio easement and patio fences的規定,說實話真心不適合我的情況,因為我向我的城市求證過我的房子是single family house,和這個patio fence沒有任何關係。我的隻是建立一個fence,而且也遵循了所有關於covenant中fence的規定。
我有兩個問題想請教,
1,secondary plat是1992年的存檔,但是hoa的網站上有一個2009年修訂過的CC&P,這個情況下是不是應該按照新的CC&P來執行?
2,鄰居把我和物業一起告了,現在讓我停工,我是不是現在必須就停工了?還是現在的隻是一個notice?原文是:
COMES NOW,Plaintiff,xxx,Pro se, having filed its Verified Complaint for Injunctive Relief and Attorneys' Fees, and moves the court to issue a preliminary Injunction prohibiting Defendants, xxx HOA and me from violating the covenants by allowing me to erect a fence in the Patio Area of his property...
WHEREFORE,Plaintiff requests that this Court set this matter and Motion for a hearing for the issuance of a Preliminary Injunction, estimated in good faith to take approximately one hour and for all other proper relief in the premise.
