I agree with this post. Although you have failed to fully stop at stop sign or didn't stop enough time, but it is weired that your got rear ended. In front of stop sign, if everybody stopped, nobody can pick up speed that fast except a sports car. So I guess he didn't fully stoped either. So when dealing with your insurance company, let them know that both of you have responsibility not just your. And don't answer any questions that his insurance company ask you, let them contact your insurance company.

Since this is your first time, you can go to court and play guilty. And also prepare some pictures and show the judge that it is not just your fault. Both the party have responsibility for this.

Show both side of responsibility is very important since he can hire a lawyer and sue you ask for big bucks. So prepare for the worst case.
