有關朋友借錢不還的事

一朋友失業了付不出房租，當時我直接把支票開給了他房東的名字。我也沒有叫他寫借條。但我有在支票的坐下角寫他的名字和房租的月份。他現在找到工作已5個月了，卻沒有還錢的動作。我現在加州，他在外州。

1. 我可以告他嗎？
2. 我幫他付的房租超過$5000, 我請律師的話，誰出律師費
3. 我現在還不想告他，有沒有一定的期限，如果超過這個期限我就不能告他了。
4. 告他的話，是以我所在的州的法律來判，還是他所在的州
