根據你在TZLC的帖子，現在是你告房客不交房租，房客反告你違規處理押金。

麻省的規定是如果違規，你必須無條件地歸還sec deposit；如果不歸壞而導致房客動用訴訟，將受三倍懲罰（treble damage）。

我的觀點：sec deposit違規和房客不付房租沒有關係。所以在eviction court裏麵是兩個案件，對方必須反訴而不是辯護。

再者，如果房客沒有搬出，你還沒有必要100%退回sec deposit，所以房客對於這個事物訴訟太早，法律上名義是“the issue is not ripe, therefore the court should dismiss the claim of improper handling of security deposit.”

在做這個辯護的同時，馬上去按規定開戶轉賬。
