The contract did not include or exclude the VB court. 
The final walk through included the VB court and the seller never mentioned to move it either by himself or his agent. During the final walk through he mentioned to my agent, myself and my wife that our kids will enjoy the lighting at night. It is beautiful. 

When I found he is seling the VB court I told him to stop. He became very angery, yelling, screming and cusing. That made me mad. 

I did retain a property lawyer who stated I own the VB court. I paid him consult fee and a demending letter fee. Not sure I should use him to fight at court. I am thinking fight in small claim court for up to $10 K.
