In NJ state, employment is defined as "by will". It is legal to discontinue the employment at any time by any reason by either party. It's legal to terminate your employment when you "failed to return to work" within a respected time period.

The worker's Comp (WC) shall pay you until the last day of work. I don't know if it is legal to terminate you when you are on WC, contact WC to find out.

You cannot collect any Unemployment Benefits if you are "totally disabled". Apply for Unemployment Benefits ONLY when you are able to do "any kind" of job meaning you are not totally disabled, you are able to work with restrictions. Since you didn't provide any medical condition, there's no way I can determine. If you decide to file for Unemployment Benefits, disclose all the medical and separation information to Dept. of Labor. It will be very helpful if you can contact your doctor to have a note for your restrictions. Again, if you are totally disabled, and it looks like based on your WC amount, do not try to apply.

Solely for the separation reason, your separation was due to Fire, Discharge because of your medical conditions.
