華人小企業的待遇

對方是一家華人小企業，希望我去工作，講明不代繳養老保險和健康保險，而且說這種做法在華人小企業中很普遍。這是事實嘛？這種做法合法嗎？

另外， 對方希望我至少為他工作三年，在合同中寫明，如果我提前離開，我要賠償相關損失。這種條款有法律效力嗎?謝謝。
