It is a standard retainer for a contingency fee case. The retainer says 33% attorney fee will be paid upon your recovery by settlement, judgment, or in another manner. It means, no recovery, no fee.
This would not include any legal fees. Any court cost must be paid by you. The attorney cannot pay such fee for you or it would be malpractice.
You may negotiate with him to make costs for subpoena, deposition or other discovery matter also contingent on recovery. That is the only one I can see that could be renegotiated.
