Yes, i rejected performance improvement plan. But, if all performance defiency are lies, why should I accept performance improvement plan? That is just the last step to throw you out. I am sure they were going to say you did not improve even with improvement plan so you are fired. I know what will you say: just take it. If fired then you have something to say in front of judge. However, if i can prove all my performance issues are lies, why should I accept the performance improvement plan? Accept the plan itself implies that I admit there is some deficiency on my performance. By the way, the performance improvement plan was installed abnormally on me: they let me travel first, then tell me you are in the plan one week already. I believe in the normal procedure, manager should discuss with me first about the plan, then I have the opportunity to express my opinion. If doing that, i would ask for an investigation on all my performance issues, which is not Visa wanted. By doing that, all lies would be revealed.

If refusing performance improvement plan is insubordinate, yes, i am.If refusing performance improvement plan is to defend my right, yes, i am too.

I think I said pretty clearly: Kin Yim was not Visa's employee. He was a contract consultant to Visa. He did not get salary/pay from Visa, and Visa did not do his performance review.
