it will be illegal if they refuse to pay your unemployment benefit after you quit and file for it. So for your own benefit, if you agree to resign, put it in writing that you only agree to do so after you are informed by your employer that you're not at fault and they will pay your unemployment benefit (which basically equals to lay off). You don't want to get yourself into such a bad situation that you have resigned and left the company but your employer refuses to pay your unemployment benefit and you have to fight with them at that time. It will take you a lot of time and efforts if that happens.
From what you described, it seems that there is still a chance that you will be able to stay. It's not easy to find a new job in this economy. Be prepared for the worst while hoping for the best. Good luck!
