We've contacted the title company and complained about it through our agent already. The title company said that first they had done their job, and they didn't find it. Second, The fee was due on July 1, which was after the closing date(5/19). Thus, it should be our resposibility. However, the thing is that the special assessment amount was specified on 5/11(which is before the closing). I am not sure if it became a lien at that point.
We'll be making a claim formally against the title for sure. But we are just worried that if they gave the same answer and refuse to pay, then what we should do. Thanks!
