再問：關於房屋買賣

根據本洲的法律,SELLER 需要提交CLOSING DOCUMENTS 在CLOSING DAY (見下麵英文段落1,摘自買賣合同) ,但是我的SELLER 沒能夠提交相應的文件.所以我的律師告訴我可以不買或等他們的文件.因為一些個人的原因,所以決定不買.但是被SELLER 的RELATOR 威脅,他聲稱不會退還我的定金,並且還會起訴我 關於他的COMMISSION 和如果房子再賣的價格差. 根據壇子朋友們的建議,我又再次看了一下買賣合同,(見英文段落2),覺得我對於他沒有理由不歸還我的定金，並且我不需要負擔他的ＣＯＭＭＩＳＳＩＯＮ　和房子再次上市後的價格差．

1. The Seller or the Seller’s lawyer will deliver normal closing documents including, where applicable, a real property reportpursuant to clause 4.11, to the Buyer or the Buyer’s lawyer upon reasonable conditions consistent with the terms of this Contract.




2."If the Seller or the Buyer fails or refuses to complete this Contract according to its terms, then the other party may pursue allavailable remedies. The Seller’s remedies include keeping the Deposits and claiming additional damages. Both the Seller andthe Buyer can claim reasonable costs including legal fees and di*****ursements on a solicitor/client full indemnity basis. "
