F1 with J2 history apply H1B

I was J2 and then transferred to F1 in China. I did not stay in China for two years before I came to USA as F1. My hu*****and have fullfilled two years home country stay in China. My questions are (1) Is it allowable for person like me to get H1B without waiver? (2)Is it allowable to apply and get greencard without waiver but under condition that J1 have fullfilled two years home country stay?

If you know any lawyer having experience on the similar cases, pls let me know. I really appreciate.
