(1) Is it allowable for person like me to get H1B without waiver?
As your hu*****and have fullfilled two years home country stay in China, you should be able to get H1

(2)Is it allowable to apply and get greencard without waiver but under condition that J1 have fullfilled two years home country stay?
Should be OK.
