I just got to know my I140&485 have been denied after over a year waiting because the graduation date for my master degree is later than the application date of the substituted labor certification. Now I have to start over again.
There are several options I have,
1. File labor application through PERM process. But I heard the success rate is very very low. And it takes employer a long time to prepare the document ready for e-filing.
2. Another labor substitution. The employer is checking if there is an approved labor certificate available. But I don't know if they can find one.
3. My fiancee got his I140 in NIW last year. He filed I485 in the end of last year. But I'm wondering what the chance it will be that his I485 will be denied. He did the 1st fingerprint this Feb. Right now he is requested to do 2nd fingerprint with code 2 (Biometrics). He has already got his EAD and AP though.
4. EB1. My lawyer said I can try. But I doubt I am qualified. I have master degree in chemistry and are working for a major pharmaceutical company. I don't have any paper published and only did posters couples of times while I was in school.
Please share your opinion on the aboved four options. Let me know the advantages and disadvantages of every option and how to prioritize those options.
