USCIS (former INS) never verified my income during either LC or GC process. As far as my understanding, what your attorney said is right. I-140 petition filed by your employer states "intention for future employment", that should include both position and salary requirement for future.

However, you should be very cautious if your earning is significantly below average earnings of your job position that stated at labor department salary guide. You should be able to find those guide on labor department's website.
