I feel so sorry hearing your story.
The lesson learned is don't use Chinese lawyers any more. A lot of them don't know what they are doing. Many of them are simply idiots.
If you want to save money, you can read the immigration law and file H1B extension by yourself. Or spend a little bit more money to hire an attorney with good reputation.
I filed my RIR in 03/2004. I expect it will be approved in about 2.5 years. I am not joking. I do not have too much time left on my H1B, so I can not withdraw my RIR and refile as PERM. I will file my 7th year extension after 03/05.
For your case, don't listen to your lawyer. If I were you, I would wait 2.5 years for the RIR. It is a very complex and dangerous procedure to take back your current RIR and refile it as PERM, because DODL doesn't encourage people to do it that way. You will end up spending much more money. Your RIR is slow, but it will be approved based on regulations on RIR. If you change to PERM, your case may not be approved because PERM rules are more strict and regid. Also, many attorneys don't know how to deal with PERM. Even DOL don't know exactly what they should do now.
