我目前處於H1b grace period。 我的EB3 PD為21年5月。 想請問關於如何滿足AC21條例的問題。
我的H1b六年於19年開始，從未離境，因該是於25年用盡，目前的797有效日期至明年六月(也許是上次transfer時extend了）。
我也許將很快申請H1b transfer。但是鑒於EB3審批日已經到了21年3月，我想請問如果遞交時排期current：
- 我將不滿足三年延期。新雇主當然沒為我遞交過PERM, 是否我的h1b transfer也將不滿足一年延期，從而無法批準。
- --It seems you have an approved I-140 from your previous emplyer, right? If so, you are qualified to continue extention of your H-1B for another 3 years beyond the 6-year limit of H-1 period because you are not qualified to file I-485 due to employer change.
- 舊雇主給提交的perm倒是在pending，是否我應該和就雇主溝通不要取消withdraw perm，是否有任何形式的幫助。
- -Do you mean this PERM was applied by your second employer? If you have an appoved I-140 from the first employer, then this PERM from the second employer does not matter, anymore.
- But if you do not have an approved I-140, then you are not qualifed to extend your H-1 if you did not work for the employer who sponsored your PERM (pending), or if the PERM pending is less than one year, you are not qualifed for extension of your H-1 beyon the 6-year limit even if you work for the employer who filed the PERM.
