您好。我配偶的485收到RFE，要求提夠成績單和其他轉身分文件。今天律師告知我配偶在她F1學生身分期間有gap，要等到和律師的meeting才能知道詳細的情況.

我們自己重新查看了所有文件，發現她的OPT是在2016/10/29到期，她的H4是從2017/01/27開始。但我們遞交轉身分的文件的接受日期是2016/10/06，但不知道為什麽H4開始的日期沒有從file的日期開始，而是從approve的2017/01/27開始，這樣就產生了近3個月的gap。

請問：

1. 這種的gap律師的explanation letter能有多大幾率被接受？

-Because your spouse filed change of status application before the F-1 OPT expired, she was leglally present in US even if the H-4 was approved about 3 months later after the F-1 expired. So, it should not affect her I-485 approval. Also, EB category immigrant applicant is allowed to have status gap, illegal employment, etc. up to 179 days. So, even if your spouse had the status gap (less than 180 days), her EB based I-485 will not be affected.

So, just discuss with the lawyer to respond to the RFE that she filed I-539 change of status application timely before the F-1 status expired and also, the H-4 status was approved less than 180 days after the F-1 status expirfed. Provide the copies of F-1 OPT EAD and I-20, copies of I-539 Receipt Notice and H-4 Approval Notice with the response letter to the RFE.

That is all. No worrisome!
