我老婆去年持因公護照J1簽證來美國進修（國內出錢），簽證上明確寫了"2 year rule does not apply"，今年8月滿1年。最近老板提出可以給延長，美方出錢，
-Even if the visa page indicated "2 year rule does not apply"，you may still be subjected to two year home resident rule. As far as I know, nearly all of the J-1 holders from Mainland China are subjected to this two-year rule, especially your J-1 is supported financially by Chinese Govenment. So, you need to contact the Chinese Embassy to make sure whether this rule does not apply to you.
有幾個問題：
1，改為美方出錢後，能否用因私護照辦理新的簽證？-Yes.如果繼續辦J1簽證，是不是給HR提供因私護照出2019表就行了？-Yes.
2，因為沒有2年回國服務的限製，想借這個機會轉為H1，用因私護照，是否可行？-Yes. But I don't think the two year rule does not apply to you. See above.
3，無論上麵哪種情況，如果在美國境內用因私護照辦好了新的J1或者H1，是不是都需要回國/出境一次到大使館去stamp? -Not need. 悲劇的可能性大嗎 （醫學，非敏感專業）？
