轉F-1時收到Request for Evidence （REF）， 現在又想轉O-1 (premium process). 如果交REF則擔心F-1如果後批會supersede O-1. 如果不交REF，又擔心O-1如被拒則失去身份。不知如何是好。能否再REF 或 O-1申請中表明自己有乃一個petition存在並且自己preferO-1?
-Do you have a legal status now (e.g. F2, B2)? If yes, your F-1 denial will not affect your O-1 (both is irrelevant). If you don't have a legal status currently and you file O-1 application now, then if your F-1 is denied, then your O-1 status application will be also be denied or O-1 approval will have no I-94, thus you can go to China to get the O-1 visa to come back. Talk to your lawyer.
