背景: 我和學校的合同是到2017年8月31日終止. 今年9月27日 剛剛拿到I-140 petition 的 approval notice.
HR 今天通知我說節後要學校雇傭的lawyer跟我談談. 我還不知道即將談話的內容, 但根據以往經驗, 實在不敢對他們抱有好的期望. 所以請教8老師幾個問題, 以做思想準備:
1. 雇主有權在8月31日之前撤回I-140嗎?
-Yes. They can withdraw the I-140 anytime. But there is not law to require that the employer have to withdraw the approved I-140 even if you do not work for the employer (i.e. they will not lose or get anything whether they withdraw the I-140 or not). So, normally the employer does not withdraw the approved I-140.
2. 如果他們撤回, 我現有的Priority date是否還有效? (將來找到新工作之後還可以用之前的PD嗎?)
-Yes.
3. 如果他們說要撤回,我有可能用什麽辦法說服他們至少在8月31日之前不要撤回嗎?
-You may discuss with them that no law requires them to withdraw the I-140 (this is different from H-1), and they will not lose anything if they do not withdraw the I-140. The lawyer should know this.
這方麵我真的沒有鬥爭經驗.
4. 您之前似乎提過如果I-140批準了,那麽H-1b可以被多次延長. 如果他們這次撤回了I-140, 換了新工作之後H-1b是不是仍可多次延長?
-If they withdraw the I-140, you can not use it to extend your H-1 anymore. If they do not withdraw it, then you can use it too extend your H-1 beyond the 6-year H-1 limit again and again.
