I lost my job during budget cutting. I applied for B visa after that. I got a receipt letter from Immigration Bureau. Never have I received any approval letter since that. Not sure what happened. Two possibilities: (1) they approved and sent out the letter, but the letter was lost; (2) they dismissed the case, not making any decision.

I got a new job now. My question is: how should I do the H1B transfer?
-Ask your new employer to file H-1 petition for you. Also provide the copy of the B-2 filing receipt or the approval notice. Hire a lawyer to help you.
Do I have to travel back to China in both scenarios?
-Depends on whether your B-2 is approved or denied. You can not do anythiong, but wait for the H-1 apparoval to see whether the approval has I-94, and if yes, then you don't need to go to China to get the H-1 visa. You had betetr ask the employer to use premium processing for the H-1 petition to get it approved in 15 days, then you will know what you are supposed to do.
