請問八老師

 

我的PERM和I140已經批準。

但是USCIS的prevailing wage比我現在的工資高很多(wage1)。公司很難加到USCIS要求的工資。

於是公司的律師就找了一個有資質谘詢公司做了一個我的職位的工資調查。調查回來的結果比我現在的工資隻多幾千(wage2)。公司同意加這幾千給我。

律師的計劃是用谘詢公司的調查結果，重新申請一個PERM和I140. 這樣加完工資後，就沒有問題了。但是這樣等於全部推倒重來。
-Don't think DOL will accept the wage your employer/lawyer themselves got as the prevail wage for PERM.

 

我想知道有沒有可能保留已經批準的PERM和I140。現在用谘詢公司調查的工資wage2,來和USCIS交涉，可以將已經批準的PERM和I140改用 wage2 呢？
-Because the PERM position is the one after you get the green card, your current salary does not matter to your approved PERM/I-140. So, you may not need to do anything to mess it up. If your employer file a new PERM and I-140 for the same position as the one for your approved I-140, your employer may need to withdraw the approved I-140 and that probably make you to take more time to get the green card. 

If your employer can not pay you the prevail salary after you get the green card, you may just find a new job and move on after you get the green card.

如果想要用wage2，是否一定要重新申請PERM和I140呢？有什麽辦法不用全部重來嗎？
